AKBAR ALI versus FOREST DEPARTMENT
Notified under the Displaced Persons (Land Settlement) Act, 1958 Section 10 and 11 Forest Act (XVI of 1927), Section 38 Constitution of Pakistan (1973), Section 199 underground land protected under section 38, Forest Act, 1927. was done. Due to the notification in his favor the defendant department remains in his possession, before the allotment and the order of verification in favor of the applicants in the application was canceled by the name of the applicant through settlement option. Forest was running on the respondent department and such land, the search of the settlement authority, under which the allotment was canceled in favor of the applicants, was based on irrefutable facts and was not open to exception.
