Under the Prohibited Degree, there was no legal compulsion to impose a condition for the delivery of a bail bond by an individual within the Prohibited Degree, in which case the female accused may be disappointed with the approval of the bail, imposed by the session judge. The condition was set aside and the accused was ordered to be released on bail by a person of his choice.
