DINAR WALI KHAN versus REHMAN DEYAR
Dir, Chitral and Swat (Administration) Regulation 1969 CL3 (b) Constitution of Pakistan (1973), Arts 185 (3) and 199e were the claimants of the applicant and the respondents in Chitral, the first territory of the state in their own right. The Federal Land Commission announced the decision in favor of the applicants, in which a half of the property has been filed. The second petition in respect of the other half of the property, however, was unsuccessful petitioner's land. The constitutional application in respect of this land was denied, his claim was dismissed, but the High Court rejected, saying that the requests were filed by the Federal Land Commission. The relief given by the CBI has been declared unjustified, allowed to be examined, even though the High Court may be within its constitutional jurisdiction, leaving the applicants benefit of what they have called the Lower Forum.
