FATEH KHAN versus MEMBER, BOARD OF REVENUE (COLONIES) DEPARTMENT, LAHORE
Sections 4, 10 and 15 of the Government Land Colonization (Punjab) Act, 1912, were abrogated in cultivating the land in dispute over land which was given to them after ownership rights in respect of the land, which almost paid off. Apart from the last installment, the entire sale of the land was canceled in the names of the applicants. On the failure to pay the last installment, the applicants have said that they are ready to pay the instant installment. The order of authority granting the proprietary rights to the applicants was never struck by any other interested party. Applicants who were willing to pay the last installment of the residual value of the land immediately could not lose their proprietary rights in relation to the underground land.
