MUHAMMAD NAZAR versus ANWAR ALI SHAIKH
The Sindh Rented Premises Ordinance 1979 Sections 4, 16 and 21, which were defended for failing to comply with the temporary rent order, challenged the territorial jurisdiction of the rent controller, which produced a photostat copy of the order. The district was listed in the jurisdiction of West Karachi. It was not disclosed by the tenant to which authority the allotment parties had issued, however, they submitted that the list was issued by the District Judge and not by the provincial government, in which case Land dispossession has already been handed over to the landlord by the tenant. About 3 years ago, the tenant controller's appeal against the tenant's defense order was not upheld.
