Sections 27 (2) (b), (4) and 34 of the Constitution of Pakistan (1973), Article 185 (3), granted leave of appeal that the trial of the accused was illegal, in that, the quality control Approval was obtained against the board company (manufacturer) and not against the accused persons (general manager and director, plant manager, production manager, quality control manager and controller), nor was the company imposed as an accused. Nor was the High Court error in seeking Section 34 of the Act in this regard
