NOOR MUHAMMAD versus AZIZ HASSAN
Martial Law Regulation 1961 No 89 West Pakistan Land Revenue Act (XVII of 1967), Section 164 Respondent was not entitled to surrender the land under MLR 89/91 because it was legally transferred to another person. The respondent had made such a sale. At various times, the sale of such land to different persons was approved some twenty years ago, but it was not yet in the mouth of the respondents that it was said two decades later. The idea was that this sale was just a hoax, just because such a transfer would be invalidated. The defendant's fresh entitlement to the case needs to be re-examined so that the respondent's dismissal holder of the case is remanded for fresh judgment in accordance with the law.
