According to the Pakistan Penal Code Section 304, Part I Constitution of Pakistan (1973), Article 185 (3) the High Court case, the exemption did not receive the proper attention of the High Court which it deserved and it needs further scrutiny. It was allowed to consider whether the acquittal of the accused was based on the evidence on record and the proper definition of the law on the subject.
