MAQBOOL AHMAD versus FARZAND ALI SHAH
Section 96 of the Azad Jammu and Kashmir Local Government Act, 1990, no suit can be instituted against any local council, or any member, officer or servant in connection with any work or in the capacity of the government till the expiry of an act. After notice of the proceedings, the suit was set up primarily against the private defendants seeking court orders against them and seeking any relief against the municipal committee or its member or official. Was not done because the previous notice was considered under Ordinance Section 96. If, alternatively, it is deemed necessary to comply with Article 96 of the Ordinance, the interim order to the extent of the public defendant would have been forbidden and no further.
