In the process arising out of a petition filed in the civil court under section 12 (2) of the Code of Civil Procedure 1908, IX of the Limitation Act (IX of 1908) and 181 of the Constitution of Pakistan (1973), Article 185 (3). Appeal allowed. In such cases, Section 12 (2), CPC, to resolve the apparent dispute between the views raised by the various High Courts in respect of the limitation period available to the applicants.
