AKHTO JAN versus GUL AHMAD
The Civil Procedure Code Order XX and Order OXX of the CPC Decision, R 5, revealed that a common reading of the exception OX, CPC Rule 5, for the court to record its findings on each separate case generally in that suit. In cases where the case is struck, the court will record its findings on each separate issue. This rule, however, exempts the requirement to record a decision on each separate issue and that is, if it is found on a particular issue. If the outgoing case will be dealt with then the court is in that case. On each separate issue, it is not necessary to record its finding or decision with its reasons, however, there is no veil with the general proposition that in competent cases, the courts below are, in practice, as far as practicable. Should be workable, record your results on them. Regardless of the cases, Order XX, incorporated in Rule 5, CPC provides that results will be obtained on each issue until the results found on a particular issue are disposed of. The costs announced on one or more of the issues involved will not be appreciated due to the inconvenience, so it is impossible to keep the general principle that it will depend on the facts and circumstances of each case. In the circumstances of the case when the gift transaction was attacked as a sale and it was found that it was clearly a gift, therefore, the barrier to relief was not so necessary as pre-arrest. As the case is remanded on remand, the final result will not be different on remand.
