At the request of the plaintiff, the Civil Procedure Code Order XVII of CPC Adjustments OXVII, R3, the trial was postponed on different dates, but their evidence was not closed on those postponed dates, instead. Was not postponed. The preliminary adjournment on the defendant's request, on the subsequent date, would not constitute a reasonable basis for closing his evidence at a later date, after which the case was not adjourned on his request, where the evidence was closed. The hearing was in such a postponement date, neither the defendant nor his lawyer was present in the court, a proper course for the trial court was held, when the case was called, action was to be taken against it.
