Sections 302/149, 324/149 and 148 Constitution of Pakistan (1973), Article 185 (3) were granted leave to appeal whether the presence of eyewitnesses at the relevant time was very suspicious. If an eyewitness is the enemy of the assailants, he could have been saved if he was present and there was no satisfactory explanation for the presence of the eyewitness on that occasion.
