PERVAIZ ALIAS PUTTAR versus STATE
Assistant Sessions on Criminal Procedure Code (CR PC) Sections 497, 498, 6, 9, 3 and 34 Prohibition (Enforcement) Order (4 of 1979), Arts 3 and 4 Guarantee, Court of Jurisdiction Bail Rejected. The Judge Additional Sessions Judge refused to grant a second bail plea without a new bail because the Assistant Sessions Judge obtained his jurisdiction from the Sessions Assistant Sessions Judge's Court, which belongs to various categories of Judicial Officers and Uses options for all practical purposes. Vest with the magistrate under Section 30, CRPC and all the courts established under CCP section 6 and 9, using the powers under section 497, act as the court of original jurisdiction under the session judge. That is, CRPC shall hereby terminate all powers under section 497, CRPC. And generally the High Court should not first make certain requests for bail without bringing the inferior court session judge into motion, so the entertainment and decision should then be made by the Assistant Sessions Judge as a court of inferior jurisdiction.
