It was money that his sister had lost. The High Court upheld the right to inherit the property because of the money spent on his father's medical treatment and last rites, simply because the brother spent money on his father's medical treatment and his funeral. The Muslim sister cannot be deprived of her inheritance. Failing to prove that he was entitled to property in residence with his father, Y granted the High Court's request for leave to appeal the High Court order.
