The Punjab Local Government Ordinance, 1979, 137 and 138 of the Constitution of Pakistan (1973), Arts 185 (3) and 199, under the Government Directive, the implementation of export tax by the District Council has been fixed by the Commissioner who has reconsidered the matter. The District Council has been remanded. An improper order of the Commission in exercising constitutional jurisdiction, which was approved under the false impression that there were no government directives, was an unconstitutional order to dismiss the appeal.
