AMIR SARDAR versus STATE
Criminal Code of Conduct (CR PC) Sections 497, 4911) and, 513 Impeachment Code (XLV of 1860), SS 436, 302 307/149 Crimes Against Property (Enforcement Hoodwood) Ordinance (VI of 1979), section 17 ( 4) In both cases it was illegal for the accused to demand cash security for the bribe of Rs 50,000 in each case on the cash security of his offer to the accused, as the criminal code for supporting such order. There was no clause in the code that the court could accept cash. Security may be appropriate to the extent such protection is offered by the accused under 5CP 513, CCPC, but the court cannot insist on cash security, with CRPC guaranteeing on bond execution. It also considers that the Sessions Court's deposit orders were modified by the Cash High Court to such an extent that in this case the accused has to pay Rs. 50,000 in each case to settle the case. Will be released on bail.
