STATE versus SPECIAL JUDGE (CUSTOMS)
A respondent applied for the release of a car used for the Commission of Crime under the Customs Act, against persons charged under section 179 of the Customs Act, 1969 under the Customs Act, 1969 Was. On 30 January 1989, the Special Judge (Customs and Taxes) moved a request for review of the order by the Collector of Customs (Caution), which was rejected by the Special Judge on 14 2 1989. The source stated that on the eve of the custody request, the customs deputy collector had provided it with a bank guarantee offer and as a result the request was made inadmissible, regarding the seized goods. The decision is within the exclusive jurisdiction of the customs authorities and that one party is in litigation. Controversial positions cannot be allowed in the court for unwanted orders which have taken exception to the jurisdiction of the Deputy Collector Customs and have taken the car into custody on the bank guarantee offer and at the same time allow it to fly hot and cold. Cannot be granted, unauthorized orders (customs and taxation) passed by the Special Judge from 30 to 1989 and 14 21989 were set aside without any jurisdiction.
