Article 300, exception IV, was not in a beneficial position because he was unarmed and the fight was not equal in that regard when the suspect felt that he was no match for the victim, to be killed with two deadly knives. Can't justify getting yourself out of a fight which, in any case, could not have led to his death or his fears, would cause severe injuries, especially when the defendant was unarmed. The exception was not covered under Section IV (X) under section IV. , PPC
