MUBARAK BIBI versus ADDITIONAL DISTRICT, JUDGE, SARGODHA
OVI, R 17 Constitution of Pakistan (1973), Article 185 (3) The trial court, under the amendment, directed the applicants to amend the case so that the form of the suit order could be reviewed before the District Court. The challenge was challenged and not only was the order set aside the amendment but in the writ petition the High Court also declared the dismissal of the case without legality, but the plaintiff rejected the amendment order. The appeal was upheld whether or not there was a valid case to allow this modification. The case and, if so, whether the trial court's order to direct the amendment was without legal authority, illegal or illegal, and could the amending court dismiss the case or remand and all other questions connected therewith? Should have passed the appropriate order. Raised in vacation requests
