AJAZ HUSSAIN versus MUHAMMAD TARIQ
Appeal to the Constitution's jurisdiction The High Court has banned the use of Section 13 Constitution Pakistan (1973), Arts 185 (3) and 1991 constitutional jurisdiction in the appeal. The courts below deliberately ignored a portion of the evidence, which was deemed to be unreadable after the High Court discussed the evidence finding the rent controller and appellate court tenant's position. The High Court spoke of the writ jurisdiction. It was concluded that if the evidence was illiterate, then the correct way would be to remand the matter to the appellate court and not proceed with the acquittal of the landlord, and that the High Court Mistakenly concluded that the evidence was recited by the courts below.
