ABDUL AZIZ versus BEGUM AZFAR SAEED
Section 2 (4) of the Constitution of Pakistan (1973), Article 199 Constitutional Jurisdiction, the exercise of the jurisdiction of the Settlement Option was not appropriate to relinquish the jurisdiction of the Settlement Option with respect to the partition of the house / bungalow. No such decision is made. Authorities exercise arbitrary or arbitrary powers by the High Court itself, which is expressly granted under the Treaty of Reconciliation, which was a clear violation of the exercise of the powers conferred upon the Settlement Officers in which the house was divided. The High Court order was set aside while the issue of settlement was retained indefinitely.
