GULSHER versus STATE
Section 497 of the Criminal Procedure (XLV of 1860), Sections 399, 401 and 402 of the West Pakistan Arms Ordinance (XX of 1965), Section 13D guaranteed the accused was armed with deadly weapons standing near the jungle and police, who, on patrol duty. Looking at them, they escaped, but they were chased and a gun and two revolvers and cartridges were recovered from the accused record, which shows that the High Court has refused any law or statute to refuse bail. Did not violate the Rules of Procedure but waived permission to appeal against the High Court order. Denied in the circumstances
