Section 10 Constitution of Pakistan (1973), Article 185 (3) The original tenant of the Government Land Horse Breeding Scheme had passed away. There were two claimants to the allotment; one was in the interest of the applicant and the other defendant, both the original tenants, the elder brother. The Collector was the son of the deceased before the allotment of the respondent's applicants, both of whom died during the trial of the case (after succession in the interest of the other brother), after the dismissal of the appeal, review and writ petition. The court sought leave of appeal, which was allowed as a leave, on two such questions when similar questions were raised. Services were reprieved
