JAM JAN MUHAMMAD versus STATE
Section 6161A Constitution of Pakistan (1973), Article 185 (3) The High Court directed the applicant to register a criminal case against the petitioner, under section 561A, Criminal Code of Conduct, to remove such direction. Therefore, Sessions denied the High Court's position. Along with the judge, the High Court acted contrary to the law in giving a direction which was almost an order for litigation against the applicant without any hearing and without explaining its position because of the High Court order. The instruction given does not constitute condemnation of the applicant. The High Court did not consider any such matter which led to the session judge being instructed not to comply with any weakness or law. Found, denied leave
