GULAB KHAN versus SETTLEMENT & REHABILITATION COMMISSIONER, RAWALPINDI
Sections 12 (2), 47 and OI, R13 Constitution of Pakistan (1973), Article 185 (3) challenged the defendants on the ground that they had served in connection with the service of the applicant's summons. Has been victimized by fraud, and has completely failed to stop it. Following the ruling on this request, a constitutional petition was eventually filed, which also failed to exclude the constitutional application. Such applicant will not succeed unless he is able to establish his application on facts related to the question of service of summons until the fact of finding a consolidation of facts against the applicant on such issue. Applicant could not be relieved on any technical matter but was denied leave of appeal.
