The evidence of the tenants' default eviction in payment of Section 13 and 15 monthly rent was accepted by the appellate court on the ground that before submitting the rent to the court, the tenant should have been given the right to make the house, the rent controller. The submission of rent alongwith was admitted under Section 13. The West Pakistan Urban Rent Restriction Ordinance, 1959, and therefore there was no determination in payment of rent, the evacuation order was fixed and in the light of the evidence available on record, the decision was taken to decide the case of the landlord. The appeals court was remanded. Accordingly the appeal was allowed
