During the course of investigation no defamatory material was recovered, within the meaning of section 497 (2). A further inquiry into the crime of the accused, the CRPC, was made, in which case the accused has long been a victim of anxiety. Detention of the accused in jail could not serve any useful purpose; any other accused was admitted on bail under the circumstances.
