Code of Civil Procedure 1908 O IX, Rr 8 & 9 and Section 151 Constitution of Pakistan (1973), Article 199 Constitutional petition, Council's restitution requested the court to telegraph it not to cause distress. Arrived at the hearing of the petition for rehabilitation, the court granted an exception to the petition, which stated that because of the severe flooding, roads and railway connections were not in order, so they could not be reached, as opposed to the defendants. No counter affidavit was filed by the defendants to do so. The lawyer did not inform the applicants about the date of the hearing on the lawyer's affidavit; therefore, he did not appear in the court for the reasons for the absence of the applicants.
