MUHAMMAD SIDDIQ versus WALI MUHAMMAD
Civil Procedure Code Order XXXXX Temporary Injections and Interlocutory Orders A XXXIX, Rule 1 and 2 Constitution of Pakistan (1973), Art 199 In the constitutional petition, the High Court stated that the finding of the following courts in previous cases was not unusual. It was sufficient for the High Court to find that there was no precedent for the plaintiff. The High Court further stated that the process in which the sale was alleged to be the basis of this case was a document of utmost skepticism. Subsequent to the plaintiff's suit in the two courts, following these findings, it was held that the sale proceedings proved to be a preliminary aspect in favor of the plaintiff, but stated that the sale Conduct was not valid.
