On the basis of the constitutional account, the Pakistan Penal Code section 307 sentenced the defendant to 6 years imprisonment for the recovery of the weapons of crime in view of the conviction, the offender and the medical report. The penalty was reduced to Rs. 5,000, depending on the financial status of the fine which was not known as proportional.
