Section 10 Special Oath of Oaths Act 1873 Where the parties agreed that a special oath should be decided, the order was passed in favor of the plaintiff on the basis of the kind taken by the defendant. Challenges cannot be allowed through a subsequent statement filed by the defendant where the defendant's decision on the basis of a special oath was not in accordance with the agreement between the parties and the decree was beyond the exclusive oath.
