MUHAMMAD RAMZAN versus MUHAMMAD SARDAR
The pre-emption suit filed by the pre-emptor in respect of the Punjab Pre-Emission Act 1913 Sections 4 and 16 Pre-Emission Suit Homes was initially ruled in their favor long before the deciding date (31 7 1986), But on appeal filed by the applicants / vendors, the order was set aside and the trial was adjourned to trial court and post-remand proceedings were in favor of PMATur after the re-trial. Although before the main date (31st 198 1986) was passed in favor of the real umpire even before the pre-historic rule. As per PLD 1988, submitted by the Supreme Court in Sardar Ali's case, SC 287's application is entitled to reinstatement of order despite subsequent remand by the appellate court.
