The right of a suit filed under section 77 of the Special Relief Act (of 1877), section 9 of the Civil Procedure Code (v. 1908), section 96 appeal, section 77, of the general court in the exercise of actual jurisdiction under the Registration Act On the face, though, the scope is limited. In a summary manner, the provisions of section 77 of the Act (XVI of 1908) will be compared to that of Section 9 of the Special Relief Act, it will be known that the latter provisions were specifically ordered. It has been said that the appeal will not be approved by any decision or order. No case under this Act, however, showed any such restriction in section 77 of the Registration Act, so that section 96 could seize the right to file an appeal under CPC.
