BENGAL WOOL HOUSE versus STANDARD INSURANCE CO. LTD.
The Insurance Act 1938 Section 106 (13) shows the validity of the Contract Act (IX of 1872), Section 45 Civil Procedure Code (VV 1908), OI, R1 Joint Insurance Policy for the plaintiff and the bank mortgage clause in the name of the bank. That is, the money payable under the policy should not be paid to the bank defendants, nor did it make any allegation from the shoe, nor did any shoe show that the mortgage loan was satisfied or the bank was entitled to the benefit under the policy. Has not been assigned to them the right to claim. The plaintiff was not entitled to file a case in the absence of the bank, as the party required not to join the bank as the plaintiff.
