MALIK ALLAH BAKHSH versus DISTRICT JUDGE, RAJANPUR
O VII, R11 and Section 9 of the Punjab Office of Ombudsman Act (X of 1997), Section 9 and 29 of the Special Relief Act (I of 1877), Section 42 Constitution of Pakistan, Article 199 Constitutional Petition to Revoke the Claimant's Jurisdiction Application for Scope The plaintiff filed a lawsuit for a declaration in which the plaintiff filed an application for rejection, which was simultaneously rejected. The Provincial Ombudsman did not determine the rights of the parties, and the order passed by the Ombudsman could not seize the jurisdiction of the Civil Court High Court and its subordinate courts. The Ombudsman operated by the Ombudsman was excluded from the jurisdiction of the proceedings, when no order was passed by the Ombudsman nor any action pending before him in section 29 of the Punjab Office. The bar was challenged. The Ombudsman Act, 1997 was defective against the plaintiff, the civil courts were considered to be the court of finality. The contradiction and jurisdiction established by them cannot be raised on the basis that the aggrieved party has already resolved to redress its complaint. Having chosen to approach the forum, the trial court will reach the point where the plaintiff was refused to file a case after the application was dismissed. The Ombudsman and the defendants will have the freedom to challenge the same application under R11, the CPC was rightfully dismissed by the courts.
