In the Civil Procedure Code Order I of CPC Parties Suite 0 1, R 10 the High Court appealed to the High Court on the transfer request by the petitioner as an interlocutor, deciding that it was a proper party. It should be enforced because the co-defendant defendant claimed that 56 acres of land had been given to him by the government, out of which 30 acres had come within 250 acres of land which the appellant had claimed on the basis of the alleged grant.
