Sections 302 and 323 allow appeals for evidence to be read with sections 148 and 149. Rules (i) that despite the fact that the witnesses were present on the spot and their evidence could not be denied because of their trustworthiness, the High Court took action to acquit the four accused. 149, charge under PPC; (ii) setting aside the convictions and convictions filed under the trial court 5 30 302/148/149, PPC against the accused and only under section 323, PPC. There is no justification for convicting them. And (iii) while retaining the conviction of two other accused under 5302, the PPC had no justification to convert his death sentence to life imprisonment because of the commission of the crime immediately.
