ISLAM COAL CO. versus GHULAM RASOOL
Sections 13 (6) and 15 Constitution of Pakistan (1973), Article 185 (3) Order of eviction temporary rent In order to collect the next monthly rent, the rent controller refuses to attack the tenant's defense, as before. By default, the High Court had granted leave to the High Court to consider the issue of accepting the tenant's explanation by the tenant controller in view of some ambiguity in the order. It was not permissible to interfere with such an order and instruct the tenant to evict. And the landlord was responsible for rejecting the request because the tenant had submitted the outstanding rental claim before filing a written statement.
