The permission to appeal paras 3, 8 and 16 (2) was granted to consider the effect of the provisions of the Martial Law Regulation 64 of 1959 on the basis of the agreement in lieu of restitution granted by the appellant to the defendant. Frustrated with the law, the defendant withheld the trial court's injunction against the appellant's right to claim on equal ground under the abandoned agreement and otherwise kept the trial court
