RASUL KHAN versus QALANDAR DIN
The Punjab Pre-Emission Act 1913 S15 Civil Procedure Code (v. 1908), OII, R 2 and Section 47 dismissed the earlier case which claimed that it was demanded in SS 47, CPC. Was filed and the appeal filed against such inquiry was not withdrawn. By the appellant, it will be contended that he did not accept the decision of the court because of the restriction against him in section 47, C. [\ C Therefore, such a previous case was not decided on merit and the plaintiff was unlawful. Due to the defective nature of the suit, where the previous suit did not decide on the merits, the O11, R2 bar, CPC will not apply to the subsequent case.
