‑‑‑S. 25‑A‑‑Transfer of family suit‑‑Husband's suit for restitution of conjugal rights pending at place 'L' whereas wife's suit for jactitation of marriage pending in Family Court 'B'‑‑Husband's suit was transferred to Family Court 'B' on plea of wife's apprehension of abduction by husband in case she went to place where husband's suit was pending.

The service of the respondent has been effected by a proclamation published in the Daily Nawa‑i‑Waqt, Lahore on 20th of February, 1986.

2. Mst. Ismat Bibi alias Azmat Bibi applies under section 25‑A of the Family Courts Act for the transfer of a suit for restitution of conjugal rights instituted against her by the respondent from the Court of Syed Shafqaat Ahmad, Judge Family Court, Lahore to the Court of Mr. Sakhi Muhammad Kahut, Judge Family Court, Bhalwal, District Sargodha where her own suit for jactitation of marriage is pending.

3. According to her, she was abducted by the respondent and subsequently recovered by a bailiff deputed for this purpose by the High Court. She denies that she was ever married to the respondent. She further states that in case she visits Lahore to defend the suit of the respondent there, she apprehends her abduction again.

4. For the above reasons, this application is allowed ex parte and the suit of the respondent is withdrawn from the Court of Syed Shafqaat Ahmed, Judge Family Court, Lahore and transferred to the Court of Mr. Sakhi Muhammad Kahut, Judge Family Court, Bhalwal, District Sargodha. Both the Courts shall be informed accordingly.
