Messrs AWAMI CONSTRUCTION COMPANY Ltd.‑‑Petitioner

versus

PAKISTAN through its Secretary, Ministry of Health,

Housing and Works and 3 others‑‑Respondents Constitutional Petition No. D‑1727 of 1978, decided on 7th October, 1985. Provisional Constitution Order (1 of 1981)‑‑

‑‑‑Art.9‑‑Petition‑‑Disposal‑‑Consent of parties‑‑Petition disposed of by consent of parties in terms that without prejudice to respective contentions of parties, respondent would reconsider matter in dispute in light of letters written by another respondent, after issuing notice to all concerned parties including petitioner‑‑Status quo with regard to property in dispute was maintained till final decision.

JUDGMENT

TANZIL‑UR‑REHMAN, J.‑‑

Heard the learned counsel for the parties. By consent the petition is disposed of in the following terms:

Without prejudice to the respective contentions of the parties, respondent No.l will reconsider the matter in the light of the letters, dated 9‑2‑1978 and 15‑5‑1978 written by the Society (respondent No.2) A to respondent No.1, after issuing the notice to all the concerned Darties including the petitioner

2.The status quo with regard to the Mosque, shall be maintained till the decision by respondent No.l is arrived at, as aforesaid.

3. It is expected that respondent No.l will take final decision in the matter within four months.

4. There will be no order as to costs.
