By this Constitutional petition a relief is being sought for a direction to the S. H. O. concerned to register a case for offence under section 330/34, P. P. C. against himself and Muharrir Police Constable of his Police Station. The allegation is that Muhammad Hanif and Muhammad Qadir were called by the police and when they refused to confess the guilt in a murder case they were given beating to which the petitioner is an eye witness. A report was called from the Police Officer, who has denied it. The occurrence is alleged to have taken place on 26th October, 1981.
2. This is an old matter in which the beating is alleged to have been given on 26th October, 1981. The petitioner has an alternative remedy open to him in law. In the circumstances of the present case I do not consider it fit to exercise my extraordinary jurisdiction. This petition is dismissed.
