Section 9 Co-operative Society Act (Second 1925), Section 54 and 70 The plaintiffs' allegations leveled against the defendants, an elected chairman of the cooperative society denies the allegations by filing an affidavit on behalf of the plaintiff. No charges Society Registrar, Cooperative Society's business already prevents both the plaintiff and the plaintiff from taking any action in connection with the General Body Meeting or the meeting of the Society's Managing Committee and conducts these meetings to supervise it. There is a controversy when it comes to the appointment of an officer. Organized by the business of the Society and S, 54, Co-operative, Societies Act, 1925 Section 70A, Co-operative Society Act, 1925, the Registrar fully attracted the matter already caught on the dispute between the parties.

The copy of the resolu tion, dated 31st March, 1983 whereby the filing of the present suit is authorised against the defendant though typed on a letter head which shows the address as Room No. 2. Aurangzeb Market, M. A. Jinnah Road, Karachi, but it also bears the seal of Society which shows the present address of Society near Malir Cantt. University Road, Karachi. The defendant in his counter‑affidavit has categorically stated that the premises namely No. 2, Aurangzeb Market, M. A. Jinnah Road, Karachi, has two separate portions and one of these is exclusively occupied by him where he is carrying on his professional work as an Advocate whereas the other portion is occupied by Mazhar Hussain, who is the Honorary Secretary of the Society. It is also stated in the said counter‑affidavit by the defendant that both these portions have separate doors and locks. No rejoinder was filed by the plaintiff denying these facts. In these circum stances it cannot be said that the defendant while objecting to the prepara tion of inventory by the Nazir committed any contempt of the orders of this Court. In fact the plaintiff while obtaining order for preparation of inventory did not disclose full facts. I accordingly reject C. M. A. No. 4041 / 1983 also.
