TAJ DIN versus MUHAMMAD ISMAIL


Article 4 (185 ()), while converting landlord and tenant agricultural land into appeals and maintaining stagnation in connection with physical possession of the parties' agreement, the Supreme Court has ordered this person to be a member of any party. Occupy the land as owner or tenant. In the production section with the landlord of the landlord's tehsildar, it is directed that the court order in the case of default by any party in the possession of any party or individual and in special deposit The money received should be invested to the parties who ultimately succeed.

versus

MUHAMMAD ISMAIL‑Respondent

Civil Petition for Special Leave to Appeal No. 1174 of 1980, decided oil 20th March, 1983.

(On appeal from the judgment and order of the Lahore High Court, Lahore dated 18‑10‑1981 in Civil Revision No. 1069 of 1979).

Constitution of Pakistan (1973)‑

---Art. 185(3)‑Landlord and tenant‑Agricultural land‑While con verting petition into appeal and maintaining status quo in respect of physical possession by agreement of parties, Supreme Court ordered that person in possession of land either as owner or as tenant of either party, shall deposit landlord's share of produce with Tehsildar of area Tehsildar directed to enforce compliance with order of Court in case of default by any of parties or person in possession and invest money so received in Khas Deposit to be given to parties ultimately succeeding in case.

ORDER

ASLAM RIAZ HUSSAIN, J.

‑‑The petition is converted into appeal and disposed of as follows.

The counsel for the parties agree that status quo should be maintained in respect of the physical possession. But the person in possession either as owner or as a tenant of either party, shall deposit the landlord's share of the produce with the Tehsildar of the area. It is, therefore, ordered accordingly.

The Tehsildar is directed to enforce the compliance with this order in case of default by any of the parties or persons in possession. He shall then invest the money so received by him in. Khan Deposits to be given to the party which ultimately succeeds.

The order shall, however, not affect any other proceedings.

M. Z. M. Order accordingly.
