Industrial Relations Ordinance (XXIII of 1969)‑--

--‑‑S. 60‑Complaint‑To be made against proper person‑Complaint made against Mills inanimate without disclosing which member of management allegedly violated order of Labour Court‑Such complaint, plaint, held, rightly dismissed on ground that proper person not made accused.

This revision is directed against the order dated 21st of March, 1982 whereby the complaint brought by the petitioner under section 60 of Industrial Relations Ordinance was dismissed on the ground that proper person had not been made accused in the case. As is apparent from the title the complaint was against Messrs Fazal Cloth Mills Limited, Muzaffargarh. In the complaint it was not disclosed which member of the management had violated the order of the Labour Court. Mills being an inanimate cannot be said to have committed an offence nor any punishment can be impose upon it. In the circumstances the complaint was rightly dismissed. There is no force in the revision which is dismissed in limine.
