This is an application for bail .on behalf of Sardar alias Dari, in a case under section 325/324/307, P. P. C. registered at Police Station Renala Khurd vide F. I: R. No. 178/81.
2. The prosecution case is that the petitioner made murderous assault on Muhammad Zubair, on 25th June, 1981 at about 5 p. m. in the area of Chak No. 7‑R.
3. Learned counsel for the petitioner submits that the injury on head of the victim had been declared simple by the doctor and that the only grievous injury is on the finger inflicted with blunt weapon. Learned counsel appearing for the State has opposed this application.
4. After having considered the arguments advanced by the parties I am of the opinion that the question of application of section 307, P. P. C. in the circumstance of the case, needs further inquiry. The petitioner is allowed bail subject to his furnishing bail bond in the sum of Rs. 10,000 with one surety in the like amount to the satisfaction of Assistant Commissioner, Okara.
