The Civil Appeal Court upheld the decision of the trial court regarding the jurisdiction and trial of the High Court's jurisdiction (v. 1908), section 115 and 96 of the High Court jurisdiction. The decision was made on the basis of the consent of the petitioner. And the scope of the lower appellate court-approved jurisdiction because the trial court did not approve the decision with the consent of the parties, the legitimate decision passed by the lower appellate court had its natural weakness in witnessing it. It was held that the order of consent cannot be challenged under section 96, CPC. This order was an order of consent before the lower appellate court, nor was the applicant heard before the recording of such an observation by the lower appellate court, in which the legal judgment and permanent error granted by the lower appellate court I was suffering, which can be examined by the High Court. The jurisdiction under section 115, the CPC High Court, set aside the decision and the case was remanded to the lower appellate court for appeal.
