ATIQUR REHMAN versus NOVELL DATA SYSTEMS PAKISTAN (PVT.) LTD., KARACHI

In keeping with section 12 (2) decree, misrepresentation and deception aside, the defendant accused the wrong decision that the plaintiff had given his correct address and the proceedings were issued at the wrong address which resulted. I had earlier proved against the defendant that no notice was found on the correct address. The defendants were never released and the service was not arranged The plaintiff failed to obtain the notice at the address as stated again in the counter-affidavit filed by the plaintiff, As mentioned in his correct address, the matter should be decided on merit. Decision making and injunction against the defendant rather than technical ability was made and application was allowed accordingly.
